Keeping up on her latest fitness routine, Nicole Richie was spotted heading to the gym in Studio City, CA on Thursday (December 2).

The former “Simple Life” beauty looked cute in her workout wear as she made her way inside the facility, paying little attention to the on-hand photogs.

Nicole Richie Restraining Order Made Permanent

On Wednesday, the hearing regarding the restraining order against Fabricio Luis Mariotto- the photographer Nicole Richie felt got too close to her daughter- has been continued until December 23, Radar Online has learned.

"The restraining order hearing has been continued until December 23. All orders remain in effect,” Richie’s lawyer Mark Geragos told Radar Online.

Nicole Richie was at the courthouse this morning for the hearing, but was kept away from the media in a secluded room. Richie believes Mariotto was lurking around her daughter Harlow's preschool and is seeking to have a temporary restraining order made permanent.

A source close to the situation added that "both parties are trying to reach an amicable settlement."

Mariotto told Radar Online: "I don't want a restraining order. Nobody waits on her, its not like she is Angelina [Jolie]."

He added that he didn’t realize he was photographing Nicole’s daughter at her school and had simply followed Nicole without realizing she had gone to a preschool.

“I’m not a bad guy, I was driving erratically,” he said.

Nicole Richie: Paparazzi Are Scaring My Kids!

Nicole Richie is going after a paparazzo tomorrow in court ... but TMZ has learned it's the beginning of a campaign she's waging against renegade photogs.

Sources connected with the case tell TMZ ... Nicole will appear tomorrow in her bid to get a permanent restraining order against Fabricio Luis Mariotto, whom she actually photographed stalking her 2-year-old child, Harlow, at her preschool.

We're told Nicole will testify that she's not scared of Mariotto, but Harlow is frightened beyond words. Nicole will tell the judge Harlow has seen Mariotto and other photographers chase and incite Nicole and it's taking an emotional toll on the child.

Nicole, who already got a temporary restraining order against Mariotto, will explain that other photogs have also crossed the line with both Harlow and Sparrow.

The children will not be present in court, nor will their baby daddy, Joel Madden.

Nicole's theme when she testifies -- It's not about her, it's about her kids ... and it must stop -- and if it doesn't she's going after the photogs who persist.

Nicole Richie Will Appear In Court Against Photog

Nicole Richie may take the stand Wednesday during a hearing in which she hopes a judge will slap a permanent restraining order against a photographer whom she feels is getting too close to her young daughter, Radar Online has exclusively learmned.

Nicole is seeking to extend a temporary restraining order -- or TRO -- against the photographer whom she claims is lurking around her daughter Harlow's nursery school. Richie will be in court with her powerhouse attorneys Tamar Arminak and Mark Geragos.

A source close to the situation tells us: "Nicole's attorneys will put on the stand several preschool teachers from Harlow's school that have witnessed this photographer crossing the line trying to get pictures. Nicole is fiercly protective of her children, and won't tolerate this. Nicole could testify also."

Nicole "is very busy planning her wedding to Joel, but she will drop everything to protect their children," the source said.

Under California law, a temporary restraining order lasts for three weeks, but if the TRO is made permanent, it will extend the order to up to three years.

The hearing will take place Wednesday morning at the civil court in downtown Los Angeles.

Nicole Richie and Joel Madden have put all their wedding plans in motion, and Radar Online has learned exclusively that the couple plan to marry in early December.

The former Simple Life star, 29, and her rocker fiancee, 31, are set to tie the knot before a star-studded guest list at the Beverly Hill home of Nicole's proud dad, music icon Lionel Richie.

"Christmas has always been about family and faith for Nicole and Joel, so there is not better time of the year for them to wed," an insider told Radar Online.

While the super-secret details of the couple's nuptials have not yet been released, Radar Online has learned that close pal Christina Aguilera and Lindsay Lohan's ex-lover Samantha Ronson are both planning to be in attendance.

The maid of honor will be Nicole's best friend, Masha Gordon, while the best man will be Joel's twin brother, Benji.

Nicole's daughter Harlow will serve as a flower girl.

Father Lionel will walk Nicole, the daughter he adopted, down the aisle, Radar Online is told.

The pair - who confirmed their engagement in February - have also engaged a top Hollywood event planner, the same woman behind the amazing nuptials of Khloe Kardashian, Jennifer Lopez and Aguilera.

Nicole and Joel are planning to invite about 75 family members and close friends to the garden wedding.

The lovebirds have been dating since late 2006 and have two children together - Harlow, 2, and one-year-old Sparrow.
